Terms & Conditions

Sales Terms and Conditions:

  1. All goods remain property of Top Tile until payment is received in full for the goods.
  2. A 20% restocking charge will be applied to all STOCKED ITEMS ONLY which are returned within 14
    days of collection or delivery. Proof of purchase will be required, otherwise credit/refund can NOT be
    issued.
  3. IMPORTANT: We DO NOT accept returns on SPECIAL ORDER ITEMS which are not kept in stock. These
    items are ordered specifically to each customers’ specific measurements or needs.
  4. A Credit/Refund can only be issued if goods are returned to us in the original packaging, unopened and
    must match the shade in stock. MIXED SHADESWILL NOT BE ACCEPTED.
  5. SPECIAL ORDER not stocked are accepted only with a deposit 50% (non-refundable). The company may
    require a full payment with the order, depending on the circumstances. NO CREDIT/REFUND ON SPECIAL
    ORDER ITEMS.
  6. It is the SOLE RESPONSIBILITY of the customer or their agent to check their order at the time of purchase,
    collection or delivery for breakages, color, shade variations, quantity and quality. Any issues in regards to
    the above mentioned not communicated on the day of purchase, collection or delivery will NOT be
    entertained.
  7. All goods collected at our stores most be examined and signed before leaving. No claims for damages or
    shortage can be accepted afterwards.
  8. In the event of a claim for broken tile or ware on delivery, all broken/damaged items must be returned
    to us before a credit note can be issued.
  9. IMPORTANT: Before tile fixing, please VERIFY the shade, calibre and grading as claims regarding these
    cannot be accepted after the tiles are fixed. It is the SOLE RESPONSIBILITY of the customer or their agent to
    ensure they are satisfied with the materials before fixing.
  10. Whereas every assistance will be provided in determining a customer’s requirements from
    drawings/measurements supplied, the final responsibility for ordering the correct quantity rests with the
    CUSTOMER or their AGENT.
  11. Colour glaze and application can vary considering over time. Samples on display are there for guidance
    only and are not necessarily in stock.
  12. Shading is an inherent quality in all ceramic tiles. Customers must order the correct quantity for their
    requirements as the company cannot guarantee to match shades of previous orders to date.
  13. All quotes by our sales team for arrival or delivery of goods are ESTIMATES ONLY. We cannot accept
    responsibility for any delays due to causes beyond our control, including manufacturing, shipping, delivery
    delays, strikes or natural consequences.
  14. All tile sizes are normal within the accepted tolerance of the ceramic tile industry.
  15. The risk of the goods shall pass to the customer on delivery or collection in accordance with these
    conditions, but the property of the goods shall not pass to the customer until payment is made in full.
  16. These terms and conditions do not affect your statutory or common law rights and do not affect your
    rights under Sales of Goods Act, 1893 as amended.
  17. All tiles and materials sold by Top Tile are provided without any implicit or explicit guarantee as to
    suitability for use in any particular purpose or location. Without limitation and irrespective of any contractual obligations Top Tile shall not be deemed negligent or liable for any damages whatsoever
    either direct, indirect or consequential which may arise from the use of tiles sold for any particular
    purpose or location.

  18. No responsibility can be accepted for any damage or injury caused by the use of the tiles. All
    customers should be aware that tiles by nature can become slippery when wet.

Delivery & Return Information

Please note that in most cases all tiles, even quantities with a low weight, need to be delivered on a pallet rather than as a parcel to minimise the risk of breakages.

  1. Deliveries are made through a network of local and national delivery partners from Monday to Friday (9am – 5pm).
  2. Most orders are delivered within 3-5 working days.  However, there will be occasions when deliveries take longer, so we strongly recommend that you do not arrange for a tradesperson to install the goods until you have received your delivery.
  3. Small deliveries of up to 30kgs are delivered to your door.
  4. Most deliveries over 30kgs will arrive on a pallet(s), usually by a tail lift vehicle and will be dropped to the nearest accessible location (kerbside delivery).  Please ensure that there is clear access to the specified delivery location. Obstructions or hazards such as uneven paths or driveways, steps, lifts, parked vehicles or other obstacles, parking restrictions etc. will impact on how close to your home the delivery can be made.
  5. For insurance and health and safety regulations, our delivery partners are unable to carry any material into your property. As your delivery will most likely include heavy items, it is advisable to have assistance to load the goods into your house.
  6. The customer or a dedicated representative of the customer must be at the point of delivery to confirm receipt. If our delivery partner is unable to gain access to the agreed delivery location or there is no one to accept the goods, an alternative delivery date will be arranged. In these circumstances, you will be charged an additional delivery fee.
  7. Please provide a mobile number when placing your order so that we can provide the best possible service when organising your delivery.

 

Cancellation & Returns

This returns policy only applies when you make a purchase Stock Items Only from our website.

  1. You have the right to cancel your order and return the goods, anytime before and up to fourteen days from the day after the goods are received by you provided that the goods are in perfect condition and the packaging remains unopened and in a sellable condition. It is your responsibility to ensure that the returned goods reach us in perfect resalable condition and therefore all goods should be in their original packaging and the packaging must not have been opened or marked. Please note that you will be responsible for arranging to return the goods and will also be responsible for the cost of returning the goods to us. A refund less a 20% restocking charge will be made upon our receipt of the returned goods once they have been inspected in our warehouse.
  2. If the goods returned are not fit for resale as a result of the goods having been opened or damaged in transit, the goods will not be refunded and you will be required to collect the goods from our warehouse within 7 days of having been notified of this fact. Alternatively if the goods have not been collected within the 7 day timeframe, the goods will be disposed of.
  3. If you change your mind about the goods when you receive them, you have 14 days after the delivery of the goods to return the goods with prior written notice to us at info@toptile.ie. However please note that cancellation of bespoke, customised or special order goods will not be accepted once your order has been processed online and no returns or exchange will be available for special offer goods. In addition to this, goods sold as part of a Sale, promotion, clearance or as ex-display will not be accepted for return or exchange after the 14 day ‘cooling off period’ has ceased.
  4. In the event that the Company agrees to accept returns from a customer, and this will be at the discretion of the Company, a handling charge of 15% will apply.
